This notice applies to the website located at https://kyzentcg.com.au and content made available by Kyzen TCG through that website.

This notice explains the ownership and permitted use of Kyzen TCG content and third-party intellectual property displayed in connection with the products we sell.

KYZEN TCG CONTENT

INDEPENDENT RETAILER NOTICE

Unless a product page or written statement expressly says otherwise, Kyzen TCG is an independent retailer and is not affiliated with, sponsored by, endorsed by or an authorised representative of any manufacturer, publisher, brand owner, franchise owner or rights holder whose products or intellectual property appear on the website.

The sale of a genuine branded product does not by itself mean that the brand owner has approved Kyzen TCG’s website, business or marketing.

Kyzen TCG intends to use product images that:

Displaying a product or its packaging for the purpose of identifying and selling the product does not transfer ownership of the underlying intellectual property to Kyzen TCG or the customer.

Customers purchasing a physical product receive ownership of that physical item, subject to applicable law. Purchasing the product does not ordinarily transfer copyright or trade mark ownership in its artwork, characters, logos or design.

TRADE MARKS

The Kyzen TCG name, logo and distinctive original branding may function as trade marks or business identifiers of Kyzen TCG, whether registered or unregistered.

Third-party trade marks displayed on the website belong to their respective owners.

The use of a third-party trade mark for product identification does not imply that the trade mark owner has licensed, sponsored, approved or endorsed Kyzen TCG unless expressly stated.

Please make complaints accurately and in good faith.

We may request additional information reasonably necessary to evaluate the complaint.

REVIEW AND REMOVAL

After receiving a sufficiently detailed complaint, we will review the disputed material and available evidence.

Where appropriate, we may temporarily remove, replace or restrict access to material while the matter is investigated.

Temporary removal does not constitute an admission of infringement, liability or wrongdoing.

Where a complaint is substantiated, we will take reasonable corrective action. This may include removing or replacing an image, correcting attribution, changing a product description or discontinuing the disputed use.

FALSE OR MISLEADING COMPLAINTS

A person making an intellectual property complaint is responsible for ensuring that the information supplied is accurate and that they have a proper basis for the complaint.

Nothing in this section prevents any person from exercising a legitimate legal right or raising a genuine concern.

LINKS AND THIRD-PARTY WEBSITES

The Kyzen TCG website may contain links to manufacturers, suppliers, social-media platforms, payment providers, carriers or other third-party websites.

A link does not necessarily imply endorsement, affiliation or responsibility for the third party’s content, intellectual property practices or services.
